BUYER

A real or legal person who places an order via the website.

The name, surname, address, phone number and e-mail information entered by the Buyer during the order will be taken as basis.

2. SUBJECT

The subject of this agreement is to determine the rights and obligations of the parties regarding the sale and delivery of the products ordered by the Buyer electronically via the website www.spoismthebrand.com.

3. ESTABLISHMENT OF THE AGREEMENT

The Buyer is deemed to have accepted this agreement electronically by completing their order.

The creation of the order is subject to the successful completion of the payment process.

The Seller reserves the right to cancel the order in cases of stock error, systemic error, or force majeure.

4. PRODUCT INFORMATION

Regarding the purchased products;

• product name,
• quantity,
• color,
• size,
• sales price,
• shipping fee,
• total payment amount

are specified on the order screen and in the order confirmation e-mail.

This information is an integral part of this agreement.

5. PAYMENT

Payments are made by credit card via PAYTR secure payment infrastructure.

SPOISM does not store, display or process credit card information in any way.

If the payment transaction is rejected by the bank, the order is not considered valid.

6. DELIVERY

Orders are sent via DHL eCommerce.

Estimated delivery time is 1 to 5 business days.

Delivery time may be extended due to public holidays, busy periods, or force majeure.

If there is damage to the outer packaging of the product during delivery, it is recommended that the Buyer has a report prepared by the cargo officer.

7. SHIPPING

Shipping fee is stated separately during the order.

SPOISM does not offer free shipping.

8. RIGHT OF WITHDRAWAL

The Buyer may exercise their right of withdrawal without giving any reason within 14 (fourteen) days from the date of receipt of the product.

To exercise the right of withdrawal, a written notification must be sent to hello@spoismthebrand.com within this period.

9. CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal cannot be exercised for the following products:

• Used products,
• Washed products,
• Products with the label removed,
• Products that are not suitable for resale due to hygiene,
• Products damaged by the user.

10. RETURN CONDITIONS

The product to be returned must be;

• unused,
• unwashed,
• with its label on,
• in a resalable condition

Returns of products that do not meet these conditions may not be accepted.

Return shipping fee belongs to the Buyer.

11. EXCHANGE

SPOISM does not offer product exchange service.

The Buyer may return the product and place a new order if they wish.

12. REFUND

The price of approved returned products will be refunded to the card used for payment within the legal period, after the product reaches our warehouse and the necessary checks are completed.

SPOISM is not responsible for delays caused by banks' processing times.

13. DEFECTIVE PRODUCT

If it is determined that the product is defective due to manufacturing, the Buyer may exercise their optional rights under the current consumer legislation.

14. FORCE MAJEURE

Parties cannot be held responsible for the failure to fulfill obligations due to natural disasters, war, strikes, epidemics, official authority decisions, transportation disruptions or other force majeure events beyond the control of the parties.

15. ELECTRONIC EVIDENCE

The parties accept that order records, payment records, system logs and e-mail correspondence created in electronic environment constitute conclusive evidence.

16. RESOLUTION OF DISPUTES

In disputes arising from this agreement, Consumer Arbitration Committees and Consumer Courts in the Buyer's place of residence or where the transaction was made are authorized within the monetary limits announced annually by the T.C. Ministry of Trade.

17. EFFECTIVENESS

The Buyer declares that they have read, understood the content of and accepted this Distance Sales Agreement electronically before completing their order.

This agreement becomes effective upon completion of the order.
